The Demise of the 28-Article Peace Initiative for Ukraine: Why Diplomatic Efforts Continue to Falter

Europe breathed a deep collective sigh of relief on Monday, as the crisis triggered by the presentation of a new 28-article proposal for resolving the conflict appeared – momentarily – to have been contained. A senior US official spoke of "significant advancement" after bilateral negotiations in Geneva. On Monday night, Moscow made its retaliation: an extensive attack of missile and drone strikes on Kyiv.

The Cycle of Peace Talks and Military Action

The succession of opposing developments captured the grim essence of the recent timeframe. By day, negotiation efforts are conducted: optimistic declarations are released from various governments. Significant resources is devoted on restraining certain initiatives. By night, the Kremlin clearly shows the world that, for them, war remains the primary tool for achieving "peace".

Nocturnal Warfare

As military strikes developed into the early hours of Tuesday, the present situation of Ukraine's vulnerability was exposed. Ukraine is capable of detecting rocket firings from across the border, a capability provided through timely intelligence. From witness perspectives, Ukrainian air force fighter jets that had been deployed to counter approaching aerial threats streaked across the sky – modern combat jets delivered to Ukraine by European allies.

Moments later, Kyiv's anti-aircraft weapons engaged: several firings deployed against a hostile projectile. This was a advanced protection mechanism at work, most likely supplied through allied countries. Every deployment creates sudden vibrations, shaking the windows. The moment of terror quickly becomes grim resignation: perhaps the incoming missile won't strike its target this time, protecting urban areas from catastrophe and additional electricity failures.

Ongoing Risks

Soon after, a heavy machine gun engaged a unmanned aircraft somewhere nearby, part of a rapid response unit – almost certainly allied-provided weaponry. Sadly, the bullets missed the enemy aircraft – it pressed on overhead toward its objective.

Periodically, this persisted until dawn. Kyiv greeted the early updates: seven people killed, destruction and utility failures in multiple buildings as a result of the nocturnal offensive. As typically, everyone still continued their routines – enduring hostilities. But those 24 hours demonstrated Ukraine's vital need on Western support – a need that neighboring countries are evidently unprepared to replace in the immediate future.

Ineffective Peace Efforts

The comprehensive proposal from Washington provoked deep reactions, debate and serious worry – and momentarily shifted focus from Ukraine's largest corruption scandal in years. Yet, we have witnessed similar scenarios, after prior negotiation attempts and international summits.

Every new proposal from Washington unfolds according to the identical sequence: a negotiation push against Ukraine, which Kyiv, with other European capitals, manages to fend off. They stabilise the situation but never actually secure success. This trend will, no doubt, continue.

Political Considerations

It is tempting to accuse specific actors of persistently promoting Moscow's conditions. But that does not seem to be the whole story. American leadership operates on a principle familiar among experienced diplomats: you cannot win at the negotiating table what you have lost on the battlefield. The American government presumes that it is unrealistic to force Russia to abandon the land that it presently holds in Ukraine's south or east.

The challenge is that while recognising this factual reality, Washington does nothing to discourage Russia, through diplomacy or military means, from thinking that the status quo will not shift further in its benefit in the near future.

Conflicting Perspectives

Therefore, the Kremlin is certain that duration works to their advantage – that Ukraine and its partners are coming close to fatigue. Their reason to agree to terms that does not give them the greatest potential benefit is almost completely absent. There may be many attempts to achieve ceasefire, but they will continue as long as Russia's government remains highly assured in the conclusion.

On the contrary, Ukraine's government believes that Ukraine can still hold out, progressively conceding lives and land but preventing a total frontline collapse until conditions improve in its advantage.

Existing Situation

Factually, there are no actual prerequisites for a armistice. Now, subjective factors are becoming relevant: political desires to mediate resolution and secure international recognition, and the government's double obstacles – on one hand, not to estrange crucial supporters, and on the other, to rally Ukrainians around the country's interests against any proposal Kyiv finds unworkable, so that their attention does not switch to domestic problems. And although their mission will now be considerably more difficult after latest incidents, it remains highly unlikely that this will modify their basic position.

These opposing factors are driving the talks.

Assessment and Future

It took a only one week to kill the suggested clauses of the current initiative. Forceful and unpredictable management of the matter by Washington, pushback by Ukraine and the rest of Europe, along with soothing efforts of negotiators, and finally, latest revelations, all achieved their purpose.

While new initiatives based on old ideas are imminent, Kyiv, London and other Western governments should draw one fundamental conclusion: Ukraine and Europe will only be able to fend off diplomatic offensives from Washington that are based on Russian demands and show specific hesitation to alter the situation, if they maintain solidarity and enhance their military capacity at a much faster pace. If they do, no combination of diplomatic or military actions will be able to overcome them. In the meantime, Ukraine's capability to defend against evening bombardments will, for the foreseeable future, primarily depend on sustained allied backing.
